Paragraph 9 of the Development <br /> Agreement specifies that the Developer be entitled to =nstruct <br /> hrildings on IDts 6, 7, and 8, Block 1 of the sub:li vision only after <br /> filing the consent doctnnent with the Ramsey County Auditor. (See <br /> attached excerpt frcnn Developnent Agreement). F= your information, <br /> Lots 6, 7, and 8 of the Plat contain a flowage easement held by the u.s. <br /> Fish and wild Life Service, which must be released prior to developnent. <br /> It appears this transaction for release of easement will take place in <br />. conjunction with the sale of lots. <br /> Attorney Filla has been in contact with Mr. McGuire and Attorney Halva <br /> regarding the draft of the consent doctnnent. Both the Attorney and I <br /> will be present at the meeting to answer any questions regarding this <br /> matter . <br /> Also attached for your information is a letter frcnn RCWD, regarding <br /> issues concerning development of these lots which will be addressed in <br /> conjunction with issuance of ooilding pennits for these lots. <br /> ~TION: <br /> staff recommends execution of the Acknowledgement of Consent. <br /> ACI'ION REOUIRID: <br /> If Council concurs, they should pass a motion auth=izing the proper <br /> City officials to execute the Acknowledgement of Consent doctnnent and <br /> require the doctnnent be filed with the Ramsey County Auditor. <br /> CJI/ts <br /> M92-16 <br />. <br />
