I have <br /> a copy which I received last month, when. the metter was first discussed <br /> with Banister's office. <br /> I see no legal objection to the Village entering into the proposed agree- <br />. ment~ assuming of course that the Council is satisfied with the payment <br /> provisions contained therein. As I see it the Council will pay one and <br /> one half per cent of the cost of construction for preliminary investi- <br /> ation and conferences, which amount will be credited against the fee of <br /> five and one half per cent for preparing plens and speoifications. On <br /> the street improvement projects already commenoed the one and one half <br /> per cent charge would thus be absorbed in the five and one half charge. <br /> In addition the Village willlRY Banistar two per cent of the cost of <br /> construction for supervision, plus seperate charges for staking work and <br /> a full t:!llle inspector, if the latter is necessary. The provision in <br /> paragraph 3 of the proposal regarding these items seems sufficiently <br /> detailed to me to avoid any misunderstanding. <br /> Of course I cannot pass upon whether or not the fees are reasonable, but <br /> I understand the Council has examined thisin detail with representatives <br /> of the Banister office and has decided that these are acceptable. Iam <br /> still holding the checks issued in August in payment of statements to <br /> date, and will hold them until I am advised by the Council that I should <br /> forward them to Banister. <br /> Yours very truly, <br /> t/~ <br />.
