hearing before the City Council on April 8, 2024, at which owners of affected properties would be <br />given the opportunity to be heard on the assessment; directed the City Clerk to mail and publish <br />notice of that hearing; and authorized full payment of an assessment at any time within 30 days of <br />the adoption of the same; and <br />WHEREAS, as directed by the City Council on March 11, 2024, the City Clerk mailed to <br />all affected properties notices of the hearing called for on April 8, 2024, which mailing was based <br />on the owner and taxpayer addresses on file in the office of the Ramsey County Assessor; and <br />WHEREAS, upon such mailing, the City Clerk was notified of an error in the County <br />records for the property located at 1570 McClung Drive that resulted in an omission in notice to <br />the owners of that property; and <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF ARDEN HILLS: <br />1. The portion of the cost of such improvement to be paid by the City is hereby declared to <br />be $2,124,615.05. The portion of the cost to be assessed against benefited property owners <br />is declared to be $718,176, which includes a portion to be assessed against the benefitted <br />property located at 1570 McClung Drive. <br />2. The assessment against the property located at 1570 McClung Drive shall be payable in <br />equal annual installments extending over a period of 10 years, the first of the installments <br />to be payable with property taxes for the year 2024, and shall bear an interest rate to be <br />determine from date of the adoption of the assessment resolution. <br />3. The City Clerk, with the assistance of the City Engineer, as directed by the City Council in <br />Resolution No. 2024-012, has calculated the proper amount to be specially assessed for <br />such improvement against the property located at 1570 McClung Drive, without regard to <br />cash valuation, as provided by law, and has filed a copy of such proposed assessment in <br />her office for public inspection; and <br />BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF ARDEN HILLS, <br />MINNESOTA: <br />1. A hearing shall be held on May 13, 2024, in the Council Chambers at 7:00 p.m. or as soon <br />thereafter as possible, to pass upon such proposed assessment, and at such time and place <br />the owner of the property located at 1570 McClung Drive, which is affected by such <br />improvement, will be given an opportunity to be heard with reference to such assessment. <br />2. Publication by the City Clerk is hereby directed to cause notice of the hearing on the <br />proposed assessment once in the official newspaper at least two weeks prior to the hearing, <br />stating in the notice the total cost of the improvement is hereby approved. Notice shall be <br />mailed to the owner of the property located at 1570 McClung Drive as described in the <br />assessment roll not less than two weeks prior to the hearings is also approved. <br />3.
