A RESOLUTION URGING THE MINNESOl2\, a:tlGRESSIc:JW\L DELEX;ATION 'ro co- <br /> ~ AND SUPPORT Cl\BLE LmISLATION WHICH WOULD PROVIDE CONSUMER <br /> PRal'D.:!'J.ON FOR Cl\BLE TELEVISION SUBSCRIBERS, PRESERVE a:MruNITY <br /> TELEVISION CIIANNELS AND FUNDING stlPPCRT, AND l'ROl'reI' THE CITY'S <br /> A11l'.IKR[Ty 'ro CCNl'ROL AND MAlOOE ITS PUBLIC RIGHTS-<JF-WAY <br /> WHERElIS, the 1984 Cable Act deregulate::! cable subs=iber rates in over 90 <br /> percent of the cable systems in the United states; and <br /> WHERElIS, the economics of cable television, like those of local telephone and <br /> electric service, do not favor head-to-head competition between cable <br /> coopanies, thereby =eating a cte facto monopoly even when franchises are non- <br /> exclusive; and <br /> WHERElIS, subscr'iber rates have in=eased draIPatically, far higher than the <br /> armual rate of inflation, since the enacbnent of the 1984 Cable Act; and <br /> WHERElIS, proposed alternatives to the cable =npany monopoly, telephone entry <br /> into the cable business and direct broadcast satellites, have no provisions <br /> for =ununity television charmels or funding for public, educational or <br /> government access; and <br /> WHERElIS, the Fe::!eral Cormmmications Commission has issue::! a ruling favoring <br /> video Dialtone Service, which would allow telephone coopanies to provide <br /> . television services without having to request a franchise to use the public <br /> rights-of-way from the local government, thereby usurping the local <br /> government's authority to control and mnage this valuable piece of public <br /> property; and <br /> WHERElIS, local regulatory cable conunissions and local governments are not <br /> protected from legal clailns challenging local regulation contemplate::! by <br /> applicable fe::!eral, state or local law or franchise; and <br /> WHERElIS, H.R. 3560, which was introduced by Congressmen Eckart and Cooper, <br /> contains provisions that clearly represent consumer interests and better <br /> balance the regulation of cable television services; and <br /> NCM THEREFORE, BE IT REroLVED by the city of Arden Hills that the Minnesota <br /> Congressional Delegation be strongly encourage::! to co-sponsor and support <br /> legislation in the House of Representatives, such as H.R. 3560, that would <br /> redress these deficiencies. <br /> This Resolution was move::! by Coilllcilperson , and duly seconde::! <br /> by Coilllcilperson . <br /> Passed and adopted this day of 1 1992. <br /> .
