. CITY OF 1IRDEN HILLS
MEM:IlANOOM
Il1a'E : .:JUly 10, 1992
TO: Mayor and city council
~:@)
Terry Post, TElIIpOrary 1\cCOUtltant
SUBJECT: Charitable Gambling Infonnational Meeting update
This morning, members fram all seven licensed charitable gambling
organizations and myself had a short meeting to discuss Ordinance No.
265 and feedback relating to proposed staff recanunenda.tions to amend
said Ordinance. The following are issues raised during the meeting:
L '!he organizations are of the opinion that precedent has been set
by the City accepting past ten percent net profit =ntribltion
payments and that any reinterpretation (i.e., disallowing
subtractions for taxes paid) would be grounds for a lawsuit.
2. Many of the organizations claim that they were given specific
. instructions fran the fonner city Administrator to use Line 36 in
computing the ten percent net profit =ntribltion. Line 36 has
already been reduced by the states taxes paid.
3. Many of the organizations claim that Attorney Filla gave tacit
approval to the organizations I method of calculation by not
challenging this subject in previous public meetings.
4. All of the organizations expressed a desire to personally contact
Mayor Sather to express their concerns about "changing the ground
rules" and denanding either a Council agenda spot or a public
hearing to discuss the issue.
5. As a technical point, the groups pointed out that Section 5-9
"Restriction of Number of bingo occasions" was inconsistent with
state law and that "bingo occasions" should be llKlre closely
defined as being evening sessions.
6. A few organizations also voiced the opinion that since I was the
only change in the City/Council personnel ~lement and things
were operating smoothly before, I l11USt be "the problem".
TRP Its
.
tJC: '1tl + (](!.
G.t:t:lc.f/
