Issuance of appropriate permits by the Rice Creek <br /> Watershed District <br /> 5. Satisfaction of the City's Park Land Dedication <br /> requirements. <br /> 6. Filing of a Landscaping Bond in an amount <br /> determined by the City's Planner. <br /> B. Developer shall have sixty (60 ) days from the date of <br /> this Agreement to satisfy the conditions stated in <br /> Sections 3(A)1 through 3(A)6 or the City Council's <br /> authorization to issue a BUilding Permit shall expire and <br /> the Developer shall resubmit site plans for approval <br /> which shall be in compliance with the current Clty <br /> Regulations. <br /> C. Developer shall construct the project according to site <br /> plans approved by the City. <br /> D. The air supported structures shall be removed wi thin five <br /> . (5) years of the date of this Agreement or Developer, at <br /> least ninety (90) days prior to the expiration date of <br /> the initial five (5) year period, shall request that the <br /> City grant an extension of three (3) additional years. <br /> Upon receipt of such request, the Ci ty shall grant the <br /> extension if Developer provides data or information in a <br /> form acoeptable to the City which indicates that: <br /> 1. Developer has made a good :Eaith effort to obtain <br /> financing for a permanent structure but is unable <br /> to obtain such financing; and, <br /> 2. Developer need additional time to repay debt <br /> incurred to construct the project. <br /> E. In the event that Developer ceases to utilize the air <br /> supported struotures as a tennis facility during the <br /> . <br /> - <br />
