OAK GROVE EXECUTIVE COMMITTEE <br /> TO: All Oak Grove Parties <br /> DATE: March 17, 1992 <br /> As you may be aware, sufficient funds have been raised <br /> pursuant to the Oak Grove Sanitary Landfill Site Trust Agreement <br /> to permit the settling parties to comply with EPA's unilateral <br /> administrative order. Notice of intent to comply was forwarded <br /> to EPA on February 21, 1992. Any party wishing to settle now <br /> must pay the lO% penalty on the settlement amount and the 50% <br /> penalty on any past-due administrative assessments as set forth <br /> in the Trust Agreement. The Appointing Parties have recommended <br /> that the opportunity to settle on the basis of the current Trust <br /> Agreement be closed on April 6, 1992. The settling parties will <br /> vote on that recommendation in the near future. Contribution <br /> litigation may be filed before April 6, 1992. <br /> The Oak Grove Parties Group ("OGPG") will meet on Monday, <br /> April 6, 1992 at lO:30 a.m. at the Marriott City Center, <br /> Minneapolis, Minnesota, for the principal purpose of removing <br /> non-settling parties from the OGPG pursuant to Section 8.2 of <br /> . the OGPG Initial Organization Agreement. All OGPG members may <br /> attend, although only eligible voters under the Initial <br /> Organization Agreement will be permitted to vote. The status of <br /> negotiations with EPA concerning response costs and contribution <br /> protection, along with other issues, will also be discussed. <br /> After the OGPG meeting, settling parties under the Trust <br /> Agreement will meet, and non-settlers will be asked to leave the <br /> conference room. <br /> 142l/GPG <br /> . <br /> (le.J2Ld fJ ) <br /> 3-,,2SI2.- <br />
