I met with Mr. podlasek. at his request, to discuss the <br /> driveway. Mr. Podlasek indicated that it was now his intention to place <br /> concrete for the entire length of his driveway and that placement of bituminous <br /> surfacing would be wasteful" as it would cost him to remove it. He requested <br /> that additional grading be done on his private property along his driveway to <br /> match into his proposed driveway improvements. I indicated that I could not <br /> authorize such additional work. I followed up this meeting with the attached <br /> letter, dated May 6, 1992. to Mr. PodlaseK. This letter stated my understanding <br /> of our meeting and that the Contractor would soon be in to complete all driveway <br /> work. <br /> Mr. Podlasek did not contact me following this letter. He did, however. stop at <br /> City Hall on May 8th and left specific direction with Ms. Cathy Iago that we <br /> should place blacktop surface back to the easement (right-of-wayl line at a <br /> Slope not to exceed 10%. Mr. Podlasek was emphatic that we not cross the right- <br /> Of-Way line "by as much as one foot." Ms. Iago phoned me with this information <br /> and followed with the attached note. This work is exactly what was <br /># accomplished. The current driveway from the road to the right-of-way line is <br /> approximately 7.9%. Had Mr. POdlasek allowed us to complete work to the spot 40 <br /> feet from the road. we would have been able to provide a slope of 5.7%. This <br /> work would have been provided without additional cost to Mr. Podlasek as it was <br /> a bid Quantity. His present driveway slope is well within all state and <br /> municipal guidelines for driveway slopes. <br /> Our offer to place bituminous surfacing to an agreed upon point beyond the <br /> right-of-way was rejected by Mr. Podlasek. The specific directions he left with <br /> City staff were carried out. <br /> All construction work on this project has been completed and the final paperwork <br /> is in process to close out the project. Neither myself or City staff have had <br /> any contact with Mr. Podlasek since May 8th, until receipt of his letter.
