The City Council approved the Foster site plan on December <br /> 10, 1990, and required that six conditions be satisfied before the <br /> building permit could be issued by the Building Inspector. As far <br /> . as I can determine, five of the six conditions remain unsatisfied. <br /> By correspondence dated December 15, 1991, Mr. Foster <br /> requested that the site plan approval be extended so that he could <br /> have more time to line up financing for the project. The status of <br /> the Foster site plan was reviewed by the City Council on December <br /> 30, 1991. The item appeared on the Council's Consent Agenda and <br /> the Council Minutes for this meeting simply indicates that the <br /> Council received "information on the expiration of permits for <br /> approved Planning Commission proj ects" . The Council Agenda for <br /> December 30, 1991, included a memo from Mr. Berg1ey which indicated <br /> that the Foster site plan approval had expired on December 10, <br /> 1991. Consequently, no action was taken on this item by the City <br /> Council. <br /> Section VIII(E)(7) of the Arden Hills Code is entitled <br /> "Expiration of Building Permit Approval" and reads as follows: <br /> Building permit approval shall automatically expire and <br /> become void one year from and after the date on which the <br /> Council granted such approval if the building permit has <br /> not been issued by the Building Inspector. Council may <br /> extend the expiration date of such permit approval for an <br /> additional period, not to exceed six months, upon written <br /> application by the person to whom the permit approval was <br /> granted. <br /> . <br />
