I have not been part of the <br /> Planning Commission discussions regarding changes to the <br /> City's regulations which would apply to the Foster <br /> property. <br /> Ultimately, any Court which is asked to review the City <br /> Council's decision will try to determine if the City Council acted <br /> in a reasonable manner. I think it is important that the <br /> conditions for issuing the building permit have not been satisfied; <br /> that the applicant has not requested a change in the conditions; <br /> that the building permit has not been issued; and that the <br /> applicant has not provided the City with an accurate account of <br /> construction related costs which have been incurred to date. If <br /> the proposed changes to the City's development regulations are to <br /> protect the health, safety and welfare of the community and if no <br /> other information is submitted relating to construction related <br /> costs, it would be my opinion that the City could successfully <br /> argue that Mr. Foster has not acquired any vested rights which <br /> would obligate the City to issue a building permit. <br /> .
