I have <br /> not been able to locate any recorded or unrecorded easements for <br /> . the area of the existing drainage pipe. <br /> It is my understanding that the City may have installed the <br /> current drainage pipe and that it has been in existence fOr more <br /> than 15 years. In addition, the City has occasionally maintained <br /> the dra:l.nage pipe. Based upon those facts, the City in my <br /> judgment, has acquired a prescriptive easement over the area of the <br /> ourrent drainage pipe. The prescriptive easement allows the City <br /> to cOntinue to use and maintain the drainage pipe in its present <br /> location. 'l1he City could replace the pipe in that location.
