A share of the development cost was paid in conjunction <br /> with the purchase of the property. [Written and Oral] <br /> Findinq: A special assessment is levied onto a <br /> property based upon the benefit the associated <br /> improvement provides, and allegations regarding <br /> other payments made to a developer or some other <br /> party do not affect the determination of this <br /> benefit. <br /> 2 . Ordinary and necessary inspection procedures were not <br /> followed by the City. <br /> Findinq: A special assessment is levied onto a <br /> property based upon the benefit the associated <br />. improvement provides, and allegations regarding <br /> inspection procedures do not affect the <br /> determination of this benefit. <br /> 3 . Assessing area residents for any part of the <br /> improvement is improper. <br /> Findinq: Those properties that in the Council's <br /> judgment benefit from the improvement have been <br /> selected for assessment. <br /> 4 . The property does not abut the pond improvement and <br /> will not benefit. <br /> Findinq: It is the Council's judgment that the <br /> improvement benefits this property by providing <br /> necessary storm water drainage.
