Independent Contractors. <br /> The City of Arden Hills cu=ently has several types of independent contractors <br /> working for the City. They are: Attorney, Planner, landscaping, Engineer , <br /> Policing, Fire Protection, Recycling, and Cable. <br /> The City in some cases has a written contract with the contractor, in other cases <br /> it does not. In the absence of a contract, the City does not renegotiate the <br /> tel:1ns of the contract on an annual = other basis. 'Ihese tel:1ns normally include <br /> cost, liability , contract tennination, quality standards , and basis of <br /> subcontracting . <br /> II. Quasi Independent Contractm-s. <br />- 'Ihere are several other areas of work that are not clearly identified through a <br /> written contract. 'Ihese include: animal control, health, inspections (heating, <br /> electric, plumbing and building) and code enforcement, diseased trees, weed <br /> inspect=, and f=ester. <br /> These individuals act in a cambined contractor/employee role. In many aspects <br /> The City provides office space, supplies and some support services. In addition, <br /> liability insurance, and errors and omissions insurance is provided through the <br /> City plan and paid for by the City. In other aspects they act as an independent <br /> contractor, such as their salary/wage is not based on the salary scale and daily <br /> or periodic work assignments and perfonnance/quality control are not provided <br /> through the city. <br /> Discussion: <br /> It would benefit the City to provide basic contract requirements f= all <br /> contractors. This also can provide for a systematic review of the service and <br /> opens the door to the option of seeking other contractors for the service, if so <br /> deemed. <br /> The above mentioned contractors/quasi contractor group shows that the provision <br /> of services to the City is mixed and lends itself to inconsistencies. The level <br /> of liability is mixed between the City and the contractor. It is unclear to what <br /> extent the City has input into the amount and type of performance standards and <br /> quality of service. Further discussion is requested to clarify the City'S intent <br /> of contractor vs. employee status. This clarification will provide more <br />- consistent quality and quantity of services to the public. <br /> -- --------- <br />
