Attachment 1 <br />'tt <br />-ABQEN HILLS <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2024-024 <br />RESOLUTION APPROVING A <br />CONDITIONAL USE PERMIT <br />FOR THE SUBJECT PROPERTY AT <br />3717 LEXINGTON AVENUE N <br />WHEREAS, City Staff received a complete land use application for 3717 Lexington <br />Avenue N. ("Subject Property") as part of a request for a Conditional Use Permit on February 17, <br />2024; <br />WHEREAS, the Subject Property is located in the B-3 — Service Business Zoning District <br />and is guided as Commercial in the Land Use plan; <br />WHEREAS, a Conditional Use Permit is required for the sale of Lower -Potency Hemp <br />Edibles in the B-3 Zoning District; <br />WHEREAS, a Conditional Accessory use shall only permitted in the B-2 General <br />Business, B-3 Service Business, B-4 Retail Business, NB Neighborhood Business and GB <br />Gateway Business Zoning Districts where the principal use is Retail Sales & Service, Restaurant, <br />or Service Station, the business has a liquor or tobacco license issued by the City, and when such <br />accessory use is clearly incidental to the principal use; <br />WHEREAS, the Subject Property meets the conditions as regulated in Section 1325.02 <br />Accessory Uses, Subd.6 for Lower -Potency Hemp Edible Sales; <br />WHEREAS, the City Council directed Staff to prepare a Land Use Application Public <br />Policy Notification to notify all property owners within 1000 feet of Subject Property when a <br />request for the Planning Commission is to occur related to a land use application that requires a <br />public hearing; <br />WHEREAS, the City's obligation has been met where the Arden Hills Planning <br />Commission duly held a public hearing on April 3, 2024.
