Therefore, the separation <br />between the garages would have been the same as <br />proposed in this request. The neighbor has given <br />written approval of the variance. <br /> <br />5. Moving the garage 5 feet to the west so a variance will <br />not be needed, will make the driveway access to the <br />proposed garage more difficult and moving the garage <br />north to get farther away from the angled lot line, <br />would not be possible without removing the 3 large oak <br />trees. <br /> <br />6. According to landscape architects on our staff, the <br />likelihood of damaging the tree would increase as the <br />garage is brought closer to the tree, covering more of <br />the root system. <br /> <br />7. There appears to be no hardship existing due to the <br />size, shape or topography of the lot, but there is a <br />trade-off - a 5 foot variance for less potential damage <br />to a large oak tree. <br /> <br />8. If the variance is not approved, the applicant could . <br />choose to: <br />a. Encroach 5 feet further on the sensitive root <br />zone. <br />b. Build a 5 foot narrower garage (19 feet). <br />c. Locate the garage further to the rear of the <br />lot (driveway would go across the roots of <br />the trees discussed earlier.) <br />d. Not build a garage. <br /> <br />Bergly concluded: <br /> <br />staff has chosen not to make a recommendation as there is no <br />hardship in this case. If the garage is constructed over <br />the roots, we would urge the applicant to delay construction <br />of the garage until after July 15th. The greatest chance of <br />triggering oak wilt due to construction activities is in the <br />spring and early summer. If the variance is granted, the <br />action should clearly state the rationale for the action is <br />to: <br /> <br />a. Minimize the damage to the 4 large oak trees. <br />b. Allow the owner to construct a garage in the <br />only reasonable location on the property. <br />c.
