The provisions of this paragraph (5) shall be deemed to be inoperable, and <br /> the requirements of Sections 2 through 10 of this Declaration shall continue in effect, if the <br /> operation of this paragraph (5) would cause the Act to be violated or cause the District to be <br /> decertified under Section 469.1761 of the Act before December 31, 2009, <br /> Section 11. Recordabilitv of Certificates and Amendments. The Certificate and <br /> Declaration as to the Qualified Project Period, Exhibit B, and any amendment thereof, the <br /> Certificate of Amendment, Termination or Deletion of Covenants, Exhibit C, and any amendment <br /> of covenants and restrictions provided for herein shall all be in such form as will enable them to be <br /> recorded with the County Recorder, Ramsey County, Minnesota. <br /> Section 12. Covenants as C'.onsideration. The covenants and restrictions set forth in <br /> Sections 2, 3 and 4 hereof constitute a pan of the consideration given and agreed to by the <br /> Declarant for the City making available taX increment revenues from the District to the Developer. <br /> Section 13. Goveminl1' Law. This instrument shall be governed by the laws of the State <br /> of Minnesota. <br /> Section 14. Notices. Other Annlicable Laws.
