The Planner/Consultant had addressed <br /> this issue with Ryder and no response to this concern <br /> has been noted. Staff is currently investigating <br /> options for enforcement. <br /> 2. Rezoninq <br /> The City needs to decide if the highest and best use of <br /> the property is a bus terminal. The business <br /> does provide convenience and service to the school <br /> and city. Its location next to the freeway and <br /> school make it less desirable for single family <br /> homes. Staff would suggest that the property's <br /> only alternative use would be as multiple family <br /> housing. <br /> . If the city believes that this is the highest and best <br /> use of the property and that improvements to the <br /> site would make it more compatible with the <br /> surrounding land uses, it could consider rezoning. <br /> The property would be rezoned to a B-2 or B-3 <br /> district and the owner would be required to obtain <br /> a SUP to continue operating. The negative to <br /> this action is that the site is then opened up to <br /> any use permitted within that zoning designation. <br /> The Council should be aware that within the <br /> Comprehensive Plan, the Lane Use Plan identifies this <br /> property and neighboring properties as "industrial". <br /> 3. Variance <br /> Based on the assumption that the improvements are <br /> considered an expansion of the use, the city could <br /> consider granting a variance to Ryder. This is also <br /> detailed in Mr. Filla's letter. This variance <br /> could include granting all or just a portion of <br /> the request. <br /> As a non-conforming use, I would find it difficult to <br /> prove hardship for this request. <br /> . <br />
