As you are aware, the proposal for storm drainage from north of Arden <br /> Place to the lake requires an easement from Mr. Johnson and his neighbor. In our discussion, Mr. <br /> Johnson indicated a willingness to provide such an easement given five conditions. These conditions <br /> are as follows: <br /> 1. The City provide a legal format of an easement to be signed and recorded. <br /> . 2. A couple of trees on Mr. Johnson's property that may potentially be damaged by construction <br /> be removed as part of the project. <br /> 3. The City be required to get all necessary permits and approvals from agencies such as the <br /> DNR and Rice Creek Watershed. <br /> 4. The storm sewer line be constructed all the way to the lake and not outlet directly on Mr. <br /> Johnson's property. <br /> 5. The City commit to assisting in cleaning of the channel should that become necessary in. the <br /> future. <br /> In addition, Mr. Johnson would expect the City to make him whole relative to his out-of-pocket <br /> attorney costs which he has estimated to be $200-$300 at this point. These costs may be slightly <br /> higher if he utilizes his attorney for reviewing the easement document prior to executing it. <br /> At this point we have not made contact with Mr. Johnson' s neighbor relative to their willingness to <br /> provide an easement. However, Mr. Johnson indicated he did not feel there would be any problem <br /> obtaining such an easement. <br /> We have reviewed the design from 1991 and have revised the construction cost estimate to reflect the <br /> extension of the line all the way to the lake and current pricing. Based on our review, we would <br /> estimate the construction cost at $20,000. Of course, the issue fucing the City would be how to <br /> finance such an improvement.
