Amej;:dll <br /> August 3, 1993 <br /> Dorothy Person <br /> City Administrator <br /> City of Arden Hills <br /> 1450 West Highway 96 <br /> Arden Hills, MN 55112 <br /> RE: Transient Merchants <br /> Hawkers, Peddlers <br /> Our File No.: 10450/920001 <br /> Dorothy: <br /> , activities of <br /> The following state regulations apply to the <br /> transient merchants, hawkers, and peddlers. <br /> TRANSIENT MERCHANTS <br /> Transient merchant is defined as any person or corporation, <br /> acting as either principal or agent, who engages in, does, or <br /> . transacts any temporary and transient business, either in one <br /> locality, or in traveling from place to place, selling goods, <br /> wares, and merchandise; and who, for the purpose of carrying on <br /> such business, hires, leases, occupies or uses a building, <br /> structure, vacant lot or railroad car for the exhibition and sale <br /> of such goods, wares, and merchandise. (M.S. $329.099). Before <br /> engaging in the business of a transient merchant, the person or <br /> corporation must obtain a license from the Ramsey County Auditor <br /> (M.S. $329.l0 and $329.11). In order to obtain the license, the <br /> transient merchant must pay a license fee and post a bond (M.S. <br /> $329.11) . In addition, the transient merchant must satisfy some <br /> state tax requirements and file the appropriate permits with the <br /> County Auditor (M.S. $329.11) . <br /> Although the transient merchant regulations seem to be broad <br /> in their scope, they contain a section which excludes a number of <br /> sales activities from the licensing requirement. Individuals or <br /> corporations who make sales to dealers in the usual course of <br /> business; or who display samples and take orders for future <br /> delivery; or who hawk their merchandise on the street or peddle <br /> their merchandise from vehicles, baskets or packs carried on their <br /> backs; or who are public officers selling goods, wares, and <br /> merchandise according to law; or who are bona fide assignees or <br /> receivers appointed by the state of Minnesota selling goods, ware, <br /> and merchandise for the benefit of creditors; or who sell or peddle <br /> the products of a farm or garden occupied and cultivated by <br /> . <br /> ',',', ", \ :~T..\l' '.'-";UG.\::,'~. <br />
