We will close on this sale October 26. <br /> I would like to respectfully offer the following objections to the proposed special <br /> assessment for the 1993 Arden Place Storm Sewer Improvement: <br /> . l. The recommendation does not include using the recently created Storm <br /> Water Utility Fund or City funding. Both are appropriate. <br /> 2. The design of the original storm sewer constructed in the 1960's was <br /> deliberately or negligently under-sized. <br /> 3. The City has failed to maintain the storm sewer, exacerbating today's <br /> problem. Money saved by the City in neglecting maintenance annually <br /> must be spent now to replace it. <br /> 4. City Attorney Filla reported at the September 28, 1992 City Council <br /> meeting that in 1982 the City approved the lot split creating 1553 Arden <br /> Place. He further stated this was based on the advice of the then City <br /> Engineer that the lot was buildable and that no drainage problem should <br /> be created by development of the new lot. My position is that the City's <br /> eagerness to have the land developed to expand the tax base precluded <br /> appropriate detailed engineering study of the drainage situation in that <br /> area. <br /> 5. Further negligence by the City in assessing potential post development <br /> drainage problems is demonstrated by issuing a building permit to Bauer <br /> Construction on November 13, 1989. The City at that time could have <br /> . again prevented development or caused the developer to take action to <br /> eliminate drainage problems in that area. <br /> -------- <br />
