CONSULTING ENGINEERS <br /> Maier Stewart & Associates Inc. <br /> MEMO TO: Dorothy Person <br /> FROM: Terry Maurer ~ <br /> RE: Appeal Process for Surface Water Management Utility Rates <br /> DATE: September 14, 1993 <br /> FILE: 520-042-70 <br /> We have reviewed the letter you faxed on September 13, 1993, from A1po Petfoods, Inc., regarding <br /> an appeal of their surface water utility assessment, and offer the following comments for the September <br /> City Council worksession. <br /> According to City records, A1po Petfoods, Inc., has two parcels with a total size of 6.64 acres. As <br /> the parcels are within General/Limited Business, their assessment rate is $50.75/acrelquarter or <br /> $337.06/quarter. <br /> . The ordinance has provisions for a property owner to appeal their assessment. It is incumbent on that <br /> owner to demonstrate that the property retains some portion of their runoff. This could be done by <br /> providing a scaled map of the property that shows topography contours and areas where runoff is <br /> retained. City staff could review this information, calculate an area which has on-site retainage for <br /> a 2-inch rainfall event in accordance with the Surface Water Management Utility Ordinance, and report <br /> to the Council on the merits of the appeal. We are aware that other communities have a lengthy form <br /> requiring detailed calculations by the owner, but this seems to be an unnecessary burden, as City staff <br /> did not go to this detail to determine the assessment. <br /> A fee reduction of 20% or greater must be demonstrated. The Council would have the ability to <br /> reduce a property's assessment by a percentage equal to that percent of the property which does not <br /> produce external runoff. The reduction, of course, would be in total area, not the rate per acre. <br /> Our contact person at Shoreview, Mr. Dave Ahrens, indicates that they receive only one to four <br /> appeals each year, and that business and industrial properties that appeal have typically received an <br /> adj ustment. <br /> To our knowledge, this is the fIrst appeal the City has received. It may be appropriate to request the <br /> necessary map and information from Alpo Petfoods, Inc., provide for a staff review of the material, <br /> and make a recommendation to the City Council. We are available at your convenience to assist in <br /> staff review of this information. <br /> .
