Variance should be <br /> granted due to the small lot size. <br /> Chair Winiecki feels that the non-conforming lot size issue and <br /> the topography of the lot and the neighboring properties is <br /> reason for hardship and is in favor of approval of the variance. <br /> Marty Rye questioned the retaining wall issue and asked if it was <br /> on an easement. Fritsinger stated that Dan Winkel and Dave <br /> Kriesel investigated the retaining wall proposal and there is no <br /> problem with it in reference to placement and snow removal. <br /> Piotrowski recommended approval of Case #93-16 based on shape, <br /> dimensions and unusual terrain. <br /> Ray McGraw seconded. Passed unanimously (6-0) . <br /> Chair Winiecki informed applicant that this case will go before <br /> the City Council September 27, 1993. <br /> CASE #93-18 - Hunters Park Ltd. <br /> . Fritsinger presented the background information on this case. <br /> The sign faces Harriet Avenue and is 18" by 16' or 24 sq. ft. In <br /> reviewing the ordinance, this sign is best described as a Real <br /> Estate Sign, Class III. Under this definition, the sign can be <br /> no larger than 6 sq. ft. and be of a temporary nature. <br /> Under Schedule VI, A of the ordinance the property can also have <br /> one (1) Area Identification Sign. This sign is currently located <br /> at the main entrance to the property on pine Tree Drive. <br /> The apartment complex is located within an R-4 district. The <br /> parcel of property consists of five acres and two buildings. <br /> Access to the above ground parking area is off pine Tree Drive <br /> and access to underground parking is from Harriet Avenue. <br /> Fritsinger concluded staff findings: <br /> 1- Staff determined that the sign is used to inform passersby <br /> that there may be units available for rent and shows the <br /> phone number and is therefore classified as a Class III <br /> Real Estate Sign. <br /> 2 . Under the ordinance, a Class III Real Estate Sign can be no <br /> greater than 6 sq. ft. <br /> . 3. Real Estate signs are considered temporary and are to be <br /> removed within five days of occupancy. <br />
