'!here have been a number of lawsuits and conflicts between these <br /> neighbors for the past three years. <br /> Mr. Miller has recently negotiated a tentative agreement relative to the <br /> settlement of the most recent lawsuit. Through a mediation process an <br /> agreement was reached that would be subject to the approval of the City <br /> Council. <br />. Attached is a copy of this agreement. You should pay particular attention to <br /> Page 1, #1 which calls for the construction of a solid fence between the <br /> property . '!his portion of the agreelOOl1t is inconsistent with Section VI,E,4,C <br /> of our Zoning ordinance which requires that all fences shall be at least 30 <br /> percent open f= passage of light and air except screening for mechanical <br /> equipment. <br /> The iInplementation of the agreement would require a granting of a variance <br /> which Mr. Miller has indicated to be appropriate to allow both parties a <br /> reasonable use of their land. Because of some recent problems between the <br /> parties, it has been requested that this agreement be approved as soon as <br /> possible. staff reviewed the agreement with the Planning Commission and due <br /> to the nature of the Court Order it was agreed that a review by the Planing <br /> Cammission was unnec,,"ssary. <br /> staff would reconunend approval of this agreelOOl1t and variance with the <br /> condition that should Ms. Flynn move or no longer continue to own a do;r, the <br /> fence be rebuilt consistent with the city's Zoning Ordinance. <br />. <br />-- ____n <br />
