As the property does contribute storm drainage to <br /> . the Lake Johanna storm drainage system, it is appropriate that the property owner is <br /> assessed a fee. As noted on the enclosed exhibit, a ditch traverses the property from the <br /> SU~vEYrNG <br /> north end to the northwest comer where it flows directly into Lake Johanna. <br /> rqJF.-;C According to city staff, this ditch has always contained some amount of water, indicating <br /> either that the swamp is discharging to the lake or that the swamp is acting as a <br /> TRJ.,\'SPORTA!.'ON "backwater" for the lakes drainage system. In either case, it is appropriate that the <br /> property is assessed a surface water maintenance fee as it contributes run off to the City's <br /> storm drainage system during periods of precipitation. Additionally, the swamp utilizes <br /> city maintained drainage ways, ditches and piping to maintain its water level and drain <br /> into Lake Johanna. <br /> The property is currently assessed as undeveloped although is does have a tennis court in <br /> the southwest comer. This results in an assessment of $5i.l4 per quarter for the 8.57 <br /> acrea property based upon the adopted ordinance. <br /> 1326 Energy Park Dme The property owner appears to. be appealing any assessment of the property under the <br /> St. Paul, MN 55108 SWM ordinance.
