Additionally, an MSA engineer and the city of Arden <br /> Hills' Public Works Supervisor visited with the property owner on December 3, 1993. <br /> ~~:'NNi~~G Based upon documentation presented to MSA, it appears that the land owner is disputing <br /> the Storm Water Management (SWM) fee of $337.06 which was assessed to the 6.73 acre <br /> . ST.!UCTU!Ai parcel. According to the SWM policy, developed property is to be assessed at a rate of <br /> $50.75 per quarter per acre. Based upon this fee rate and an area of 6.73 acres, the <br /> SU,~VEYING property should receive a SWM fee of $341.55 per quarter. <br /> :~:~',::c It appears from Mr. Harvey Stewart's letter dated August 24, 1993, he feels that the <br /> property not covered by building or pavement is not developed. This issue was explained <br /> to Mr. Stewart during our meeting on December 2, 1993 and although he does understand <br /> ~~A,".sP:::,:t.J ;,'CN the policy, he does not agree with it. However, even though the property may not be <br /> developed to the fullest extent possible by definition, the parcel is considered developed <br /> property. <br /> In a second letter dated October 21, 1993, Mr. Harvey indicated that he may be of the <br /> opinion that the southern portion of the property (which had been sold to Cardiac <br /> Pacemakers) was being assessed a SWM fee to be paid by Alpo Foods. Based upon <br /> calculations completed by MSA, it appears that this is not the case and that the only <br /> property he is being assessed a SWM fee for is the actual Alpo Foods property. <br /> 1326 Energy Park IlrWe There is a small wetland area within the A1po Property which does receive greater than <br /> SI. Paul, MN 55108 20% of the property's runoff; however, it is only approximately 2,500 square feet in area <br /> 612.64.4-4389 with an approximate volume of 5,000 cubic feet. Therefore, the capacity of this small <br /> wetland area will be exceeded by the one-year storm. To simplify this issue, the small <br /> Fax: 612.644..9446 wetland would overflow onto adjacent properties on a regular basis based upon standard <br /> . 9800 Shelard Parkway storm drainage calculation practices.
