In <br /> reviewing amended SUP #75-6, it may l:e construed that the <br /> swirrrning pcol was an amenity required by the City in order for <br /> =nstruction of additional lots. <br /> The Planning Ccmnission has not l:een appointed with the <br /> responsibility of enforcing and/or negotiating the Park <br /> dedication fees or Code of Ordinances. These duties are the <br /> resp::msibility of the City Council and Parks Comnittee, <br /> Chapter 14 of the Cede of Ordinances addresses l1'Obile homes in <br /> Arden Hills. There are no requirements within this chapter of <br /> the Ordinance which require the rrobile home park to specifically <br /> maintain a swirrrning pcol. <br /> . However, Section 14-59 does address recreational areas, It <br /> states that "all l1'Obile home courts shall have one or l1'Ore <br /> recreational areas which shall J:e easily accessible to all =urt <br /> residents ... All equipment installed in such an area shall l:e <br /> owned and maintained by the owner or operator at his own <br /> expense. 11 <br /> The swimning pcol was not required as part of the park <br /> dedication ordinance. Because the swimning pcol was not part of <br /> the park dedication, staff l:elieves that Section 14-59 would not <br /> apply in this case. <br /> At the April 21, 1975 City Council m=eting, reference was made <br /> that under the Park [;edication Ordinance, 6 acres were required, <br /> The Park easement was approved as 3-1/2 acres and the developer <br /> was to install all equipment according to village <br /> specifications, There was no reference to the swirrrning pcol, <br /> At the July 12, 1976 City Council meeting, representatives of <br /> the l1'Obile home park approached the Council and arrong other <br /> . issues raised a concern aJ:out the swirrrning pcol, The Council <br /> --- ---.- <br />
