<br />. in the complaint are found to be true; or the complainant, if the. <br /> facts are found to be untrue. <br /> SECTION 5-38. MUZZLING PROCLAMATION BY MAYOR. Whenever the <br /> prevalence of rabies renders such action necessary to protect the <br /> public health and safety, the mayor shall issue a proclamation <br /> ordering every person owning or keeping a dog to confine it <br /> securely on his premises unless it is muzzled so that it cannot <br /> bite. No person shall violate such proclamation, and any unmuzzled <br /> dog running at large during the time fixed in the proclamation <br /> shall be killed by the police without notice to the owner. <br /> (Ord. No. 198 15, 6-27-77) <br /> SECTION 5-39. VIOLATION: PENALTIES. Violations of this <br /> article shall be a misdemeanor and, upon conviction thereof, shall <br /> be punishable by a fine of not to exceed three hundred dollars <br /> ($300.00) or imprisonment for a period not to exceed ninety (90) <br /> days, or both. The minimum fine for the first offense of a dog <br /> shall be twenty-five dollars ($25.00) . The minimum fine for any <br /> subsequent offense by the same dog shall be fifty dollars ($50.00). <br /> (Ord. No. 198, 18, 6-27-77) . <br /> SECTION 5-46. LICENSE REOUIRED; FORM. <br /> (a) Every owner of a dog or cat more than six (6) months of <br /> age shall cause such dog or cat to be registered, numbered, <br /> described and licensed through the office of the clerk- <br />. administrator of the city. Such registration, numbering and <br /> licensing shall be for two (2) years for such dog while owned 10 <br /> kept by the same person while living at the same address. <br /> (b) The license shall be a metal tag issued by the clerk- <br /> administrator. (Ord. No. 198, 2, 6-27-77) <br /> SECTION 5-47. INITIAL FEE; FEE FOR DUPLICATE TAG. <br /> (a) The fee for registration, numbering, description and <br /> licensing shall be as established from time to time by the council <br /> in a resolution adopted thereby. <br /> (b) Duplicate licenses for lost tags or the changed address <br /> of the owner shall be issued upon application to the clerk- <br /> administrator and payment of such fee as is required from time to <br /> time by the council in a resolution adopted thereby. (Ord. No. 198, <br /> 2, 6-27-77; Ord. No. 217, 2, 12-29-80) <br /> SECTION 5-48. LICENSE TAG NONTRANSFERABLE. No owner of any <br /> dog or cat shall transfer its license tag or place or permit to be <br /> placed such tag upon any other dog or cat than the one for which <br /> such tag was originally issued. (Ord. No. 198, 5, 6-27-77) <br /> SECTION 5-49. RABIES VACCINATION REQUIRED PRIOR TO ISSUANCE OF <br /> LICENSE. Before any license shall be issued for any dog <br />. or cat, the applicant for such license shall furnish a certificate <br /> from a licensed veterinarian that such dog or cat has received a <br /> rabies vaccination within one year.
