The applicant had originally applied for a <br /> variance to the front yard setback to allow for =nstruction of this <br /> heme. <br /> The front yard setback requirement in this zoning district is 40 feet. <br /> The applicant had requested a variance which would have allOloled the <br /> heme to be built at the same setback, 19 feet, as the adj acent barre <br /> l=ated at 1175 Eclgewater Avenue. There are no other barres located on <br /> . the east side of this block. The applicant I s property consists of <br /> wetland, and wetland is present north of the site. <br /> In reviewing the Zoning Ordinance with City Staff, it was noted that <br /> Section VI, C, 1, (a) may apply in this case. This section states <br /> "Where existing principal buildings have a different setback fran the <br /> minimum setback required herein, the front setback of a new principal <br /> structure shall not be less than the prevailing setback in the <br /> irrrnediate vicinity. The Administrator shall determine the necessary <br /> minimum front setback in such cases." <br /> After further review with the Planning Chairperson and City Attorney, <br /> staff has made the determination that this section of the ordinance <br /> does apply and that no variance is required. The applicant will <br /> continue to ....x:>rk with both RCWD, to obtain all necessary pennits, and <br /> the City, on necessary fill pennits. <br /> BF:to <br /> . <br />
