Highway 96 <br />Arden Hills, MN 55112 <br /> <br />Hand-Delivered <br /> <br /> <br />Re: 1994 Pavement Management Improvement <br />PIN Number 34-30-23-13-0004 <br /> <br />Dear Ms. Person: <br /> <br />Please consider this letter as notice that the undersigned <br />owners of the property located at 3390 Dunlap street N., object to <br />and intend to appeal our assessment of $3,687.50 in connection with <br />. the proposed road improvement to Dunlap street North scheduled for <br />summer of 1994. This letter is intended to satisfy the <br />requirements of Minnesota statutes S 429.081 as to filing a written <br />objection with the city administrator to protect our appeal rights. <br /> <br />We object to the assessment for the following reasons: <br /> <br />1. The proposed "improvement" does not benefit our property. <br />We believe that the proposed improvement will actually detract <br />from the value of our property. <br /> <br />2. Although we were assessed for 125 feet of "frontage", only <br />thirty (30) feet of our property abuts the proposed <br />"improvement". The remaining 95 feet abuts a road that is <br />unimproved and is not intended to be improved in the proposed <br />assessment or in the future. The Assessment Manual adopted by <br />the City of Arden Hills states that, because our lot is <br />platted, our frontage assessment is to be measure along the <br />property line "abuttina the improvement". The most our <br />property may be assessed is for 30 feet. Any argument that <br />this assessment may be based on usage is arbitrary and <br />capricious, is not warranted by actual usage and is also not <br />authorized in the Assessment Manual. <br /> <br /> <br /> <br />. <br />
