Filla and in reviewing the existing case files, the <br /> following infonration nay clear up scm; of the questions raised at <br /> that rreeting. <br /> l. The City is responsible for the maintenance of the recreation <br /> . park area. This does not include the swimning pool, tot lots or <br /> parking area. <br /> 2. The City has never taken responsibility for the <br /> stonnwater/drainage in the park nor is it responsible to <br /> maintain the stontWater runoff, <br /> 3. Section 14-59 of rmmicipal code addressed recreational areas in <br /> nubile heme parks. Our attorney has clarified this in stating <br /> that as long as the swimning pool is required as part of the <br /> SUP, the swinming pool must be maintained for the tenants use. <br /> 4. The attorney went further to state that Section 14-59 does not <br /> require the swirrming pool to operate forever and the City does <br /> have the ability to amend the SUP to renove the swirrming pool <br /> requirerrents. <br /> BF:to <br /> . <br /> ---- <br />
