The City of Afton would like to stop the appeal due to the cost and has <br /> requested support from other cities. <br /> Malone stated that City Council members are dependent on the League of Minnesota <br /> Cities for legal expenses. It is the Council's responsibility to maintain the League <br /> of Minnesota Cities Insurance Trust. The League is defending itself from others who <br /> may try to collect on retroactive coverage. It is like claiming an insurance company <br /> should pay claims that were not insured. Malone stated he could not support the <br /> resolution. It is not clear why the League is appealing the decision rendered in their <br /> favor and charging Afton legal expenses, when Afton did not want to pursue an <br /> appeal. It is confusing. However, it is important to keep the League of Minnesota <br /> Cities whole, and he proposed no action be taken. <br /> By consensus of the Council, it was agreed to take no action on the matter. <br /> Person referred Councilmembers to the water loss report submitted by the Public <br /> Works Superintendent. This item is expected to be on the July work session agenda. <br /> . Hicks stated that he assumes that staff have responded to the resident with the <br /> question about water utility bill recently received in the packet to Council from Mr. <br /> Gene Yates. <br /> City Accountant, Terry Post, stated that his recollection is that he responded to the <br /> resident in writing. He will verify that for the Council. <br /> Malone stated that if the City has to replace watermains, the smartest technology <br /> should be purchased. It is a matter of how to finance the project. <br /> Person noted that the Council discussion on the 1995 budget will be taken up at the <br /> July work session. <br /> Person referred Councilmembers to the memo from Mr. Terry Maurer, MSA <br /> Consulting Engineers, regarding the Ramsey County Turnback Proposal as a point of <br /> information. <br /> COUNCIL COMMENTS <br /> Malone noted the two proposed changes to the animal ordinance from the Animal <br /> Control that appear to be sensible mechanical details. <br /> . Probst asked if there was an update from the Army Reserve regarding retrocession. <br />
