CITY OF <br /> RESOLUTION NO. <br /> A RESOLUTION EST ABLISIDNG A SEPARATE ACCOUNT FOR CABLE <br /> FRANCHISE FEES AND SPECIFYING mAT THE FUNDS IN THIS ACCOUNT MAY <br /> ONLY BE USED FOR CABLE-RELATED ACTMTIES <br /> WHEREAS, the City of is a member of the North Suburban Cable <br /> Communications Commission, which was established by a Joint and Cooperative Agreement <br /> between the Cities of Arden Hills, Falcon Heights, Lauderdaie, Little Canada, Mounds View, <br /> New Brighton, North Oaks, Roseville, St. Anthony and Shoreview, pursuant to Minnesota <br /> Statutes Section 471.59; and <br /> WHEREAS, the Grantee of the cable franchise pays franchise fees to the City; and <br /> WHEREAS, the cable subscriber ultimately bears the cost of the franchise fees and ought <br /> to be the beneficiary of their use, either in cable franchise administration or in community cable <br /> television programming; and <br />. WHEREAS, Article X, Section 3, of the Joint and Cooperative Agreement states that, <br /> after making its annual contribution to the budget of the North Suburban Cable Communications <br /> Commission, the remainder of any franchise fee paid to the Member by the Grantee shall be used <br /> for cable-related expenses; and <br /> WHEREAS, the North Suburban Cable Communications Commission does, from time to <br /> time, make available grants to assist the Member Cities with the purchase of video equipment to <br /> be used for programming the municipal access channel and to assist cities with the costs of <br /> producing a specific program or series of programs; and <br /> WHEREAS, in order to be eligible for such grants, a Member City must be able to <br /> document that its franchise fees have been used primarily for cable-related activities; and <br /> WHEREAS, the most effective way to establish such documentation is to establish a <br /> separate account for franchise fees and specifying that the funds in this account may only be used <br /> for cable-related activities; <br /> NOW, THEREFORE, BE IT RESOL YED by the City of <br /> 1. That the City will establish a separate account for franchise fees, or their <br /> equivalent. <br />. <br />
