Said notice shall be addressed <br /> to Developer to the attention of John B. McClung, at the <br /> following address: 4326 North Snelling Avenue, St. Paul, <br /> Minnesota 55112. It sha 11 constitute, without further <br /> action, notlce to any contractor or subcontractor of the <br /> Developer. <br /> b. In the event Developer fails to correct such default <br /> within the time fixed by the notice from the Engineer, <br /> the City may, at its optiotl, perform the work tlecessary <br /> to correct said default, and Developer shall thereafter <br /> promptly reimburse the City for all direct and indirect <br /> costs of such correction incurred by the City. <br /> c. 11'1 the event the default precipitates an emergency, as <br /> determined by the Engineer, the written notice to <br /> Developer required hereinabove shall be and hereby is <br /> waived in its etltirety, and Developer shall reimburse the <br /> City for any expense incurred by it in correcting the <br /> default in the same manner as if mailed notice, as <br /> hereinabove described, had been given. <br /> 3.6 The Engineer shall inspect the improvements to be made <br /> hereunder from time to time during the course of their <br /> construction. The Engineer shall not, howeVQr, render full-time <br />. inspection services. Such services shall instead be provided by <br /> the engineering firm retained by Developer which prepared the plans <br /> and specifications for the project. The project inspector <br /> representing such engineering firm shall provide the Engineer with <br /> weekly inspection reports which shall contain sufficient <br /> information so as to enable the Engineer to determine whether the <br /> improvements are being constructed in compliance with the plans and <br /> specifications. Developer shall notify the Engineer I-lithin <br /> reasonable times so that the Engineer may inspect construction of <br /> the improvements before such construction work is covered. <br /> 3.7 Upon completion of the project and prior to issuance of <br /> the Engineer's letter of final approval, the Developer, or the <br /> engineering firm it has retained for the project, shall provide the <br /> Engineer with a complete set of reproducible as-built plans of all <br /> underground utilities which shall show, at a minimum, the location, <br /> size, type of material and grade of all underground utilities <br /> installed as part of the improvements. <br /> 3.8 If, the ~ngineer is satisfied that the improvements have <br /> been completed in accordance with the plans and specifications, and <br /> has received the as-built plans, the Engineer shall indicate final <br /> approval of the improvements in writing by a letter addressed and <br /> mailed to the Developer, the City Council, and the City Attorney. <br /> The date of such letter shall constitute the date of the City's <br /> acceptance of the improvements dedicated in the subdivision of <br />. McClung Fourth Addition and the improvements shall become the <br /> 3 <br />
