Rust <br /> Our File No.: 10480/930250 <br /> Dear Dave: <br /> As you are aware, there has been little activity regarding the <br /> above-referred to property over the past several months. Recently, <br /> I drove past the property to view it to see if there have been any <br /> changes. It did not appear to me that any changes have taken <br /> place. It's my understanding that Lawrence Rust, the son of Mr. <br /> . Rust, was going to take some steps to remove the "junk" and keep us <br /> apprised of the results of his efforts to do so. We have not heard <br /> from him and evidently, he has been unsuccessful in removing the <br /> junk. I have tried a couple of times to give him a call regarding <br /> this matter. Both times, there has been no answer at the phone <br /> number which we were given. <br /> It would be appreciated if you could inspect the property in <br /> the near future and determine whether or not any of the vehicles <br /> have been removed and if there are any additional vehicles which <br /> are on the property. For ease of reference, I have faxed along a <br /> copy of an inventory of the vehicles which was previously prepared <br /> by you. <br /> There are two possible methods of handling the vehicles. One <br /> is pursuant to Minn. Stat. 5l68B dealing with abandoned vehicles, <br /> While it is not entirely clear, it appears that the statute would <br /> be applicable in this case. Procedurally, the City would first <br /> have to make the determination that the vehicles were "in an <br /> inoperable condition such that [they have] no substantial potential <br /> for further use consisent with [their] usual functions." Next, the <br /> City would remove the vehicles from the premises, notify the owner <br /> of the removal after which time the owner would have the <br /> opportunity to redeem the vehicles, or allow the City to dispose of <br /> them pursuant to public auction. (The process is a little bit <br /> more complicated than that described, although the above is a fair <br /> . summary of it.) <br />
