Page Two <br /> september 6, 1994 <br /> 4. xnvestigation/Due Diligence period: Buyer shall have <br /> six (6) months to perform any and all due diligence to <br /> determine the condition of the Property and its <br /> suitability for Buyer's intended purchase and <br /> development (the "Due Diligence Period"). <br /> During the Due Diligence period, Buyer shall have the <br /> right, but not the obligation, to perform the following <br /> procedures: <br /> physical: Inspect all physical aspects of the <br /> property, including soil and other <br /> testing. <br /> Environmental: Review all environmental reports and <br /> other studies. Seller will deliver all <br /> environmental reports in its possession <br /> to Buyer upon signing of this letter. <br /> In addition, Buyer may commission its <br /> own Phase I or Phase II environmental <br /> studies, inspection and/or testing. <br /> Survey/Wetland <br />. Delineation: Buyer may commission a boundary and <br /> topographical survey of the Property and <br /> a study to delineate and categorize any <br /> wetlands existing on the property. <br /> Regulatory: Investigate all zoning, code and <br /> governmental requirements. <br /> Title: Review preliminary title reports and <br /> survey. Seller will deliver any title <br /> reports or surveys in its possession to <br /> Buyer upon signing of this letter. <br /> Leases and <br /> Agreements: Review any leases, service contracts, <br /> easements or other agreements affecting <br /> the property. Seller will deliver <br /> copies of any such agreements to Buyer <br /> for review upon signing of this letter. <br /> Governmental <br /> Approvals/ <br /> Development <br /> Agreement: Obtain any approvals, permits and other <br /> commitments from the city of Arden <br />. Hills, and from other governmental units <br /> having jurisdiction over the property, <br /> as Buyer deems necessary and appropriate <br /> . .......- <br />
