The vacancy has never been effectively filled <br /> by a Council appointment. Instead. Council Member Probst. as the <br /> "Acting Mayor". has been performing the duties of the Mayor but he <br /> has not resigned his position as a Council Member. <br />. Besed upon the election results, you have asked 1f tnere 1s <br /> some way to allow Council Member Elect Susan L. Keim to begin <br /> serving as a Voting Council Member before January 1. 1995. I would <br /> suggest the follOWing procedure: <br /> 1. Council Member Probst shOUld resign as a Council Member <br /> and the Council should declare a vacancy in the Probst <br /> Council Seat. <br /> 2. At this point. there would be a vacancy 1n the Off1ce of <br /> Mayor and a vacancy in the Council Seat formerly held by <br /> Council Member Probst. <br /> 3. The three remaining Council Members could then take two <br /> separate actions: <br /> a. First. Mr. Probst could be appointed to fill the <br /> vacancy in the Office of Mayor for the remainder of <br /> former Mayor Sather's term. <br /> b. Second. the newly appointed Mayor Probst and the <br /> remaining three Council Members could appoint <br /> Council Member Elect Susan L.
