The recently extended Preliminary D=veloprent Agreement expires on December 13, 1994. Recently, the city and developer were made aware of at least one other party who has been atterrpting to acquire portion of this property. This has severely irrpacted the acquisition efforts of Everest. . The other party who is atterrpting to acquire land is !JA:)rking with a specific fim who v-.alld like 30 acres of this site. This finn v-.alld construct an approximate 150,000 sq. ft. manufacturing facility and the remainder of land acquired by the catpany v-.alld be available for future expansion. While the specifics of this project are l.lIlkna.m, the general use does appear to rreet the zoning requirements of the GBD. Ho\.o1ever, the use does not appear to be c:arpatible with the coIpOrate business park concept for which the GBD zoning was intended. Attached the City Council will find a letter fran Everest requesting an opportunity to have this issue discussed at the November 17, 1994 \oIOrksession. They !JA:)uld like to revisit satE of the issues as they relate to their concept and what steps are necessazy by toth parties to ensure that the business park vision is ac=nplished. As the letter indicates, I do not feel that the city can do anything other than reiterate its support of the Gateway Business District concept until such tiTre that all conditions of the Preliminary Agreement are sul::mitted to the City. The critical element of those conditions is the proj ect profonna staterrent. I have encouraged Everest to sul::mit these documents as soon as possible so the City can then ccmplete its due diligence. .
