Bethel College and Mutual <br /> Service Insurance have both sul:mitted the appropriate appeal. Land 0' <br /> Lakes had called earlier this year with questions regarding an appeal. <br /> Staff informed the Land 0' Lakes representative that to appeal the fee <br /> they 'AKJUld have to prove that 20% of the surface water is retained on <br /> their property. I have not heard back: frcm Land 0' Lakes. <br />. 'Ihe Mutual Service Insurance appeal is based on the fact that they <br /> retain surface water on their property, While it is true, that <br /> ponding areas ~ built as part of the site develq;ment, staff <br /> relieves that the surface water is detained for a short period of titre <br /> rather than retained. Staff has reviewed the situation on site and <br /> has observed. large arrounts of water discharged frcm the pond located <br /> on the Southwest corner of the property into the drainage ditch on the <br /> east side of Highway 51. 'Ihe surface water then runs into Lake <br /> Johanna . I concur with Engineer Greg Stonehouse's letter indicating <br /> that the appeal for Mutual Service Insurance should 1::e denied, <br /> Bethel College has listed four items as prinm:y concerns regarding the <br /> Surface Water Management fees. 'Ihe concerns include: <br /> l. Street and Highway Right-of-Way exemptions frcm S,W.M, <br /> utility fees, <br /> 2. Lake surface exerrptions b'CXll S.W.M. utility fees, <br /> 3. Property classified as institutional but assessed as <br /> limited and general industrial business. <br /> 4, 'Ihe arrount of water retained within the Bethel College <br /> Property. <br />. <br />
