Although the Bethel College campus is currently 85% undeveloped property, the <br /> property is zoned institutional and, therefore, could have been developed in the <br /> past, could be now, or may be in the future. The SWM utility program assesses <br /> property based upon the zoning type, not the amount of developed property. Mr. <br /> Hjelle did pose the question of where does property zoned institutional fall within <br /> the ordinance, as there is no specific category for institutional property, For <br /> purposes of this analysis, the institutional property is considered Limited and <br /> General Business. <br />. In terms of runoff retained within the Bethel College property, it appears that the <br /> wetlands presented on the R:unsey County half.=tions for the a.--ea show eithcr <br /> Rice Creek Watershed District easements or direct contact with Lake Valentine. As <br /> Lake Valentine is within, and contributes to, the Rice Creek Watershed District <br /> drainage, it appears that this claim is also invalid. If the property owner can <br /> demonstrate that a minimum of 20 % of the runoff from the property is both retained <br /> and produces no external runoff, a reduction may be justified; however, based upon <br /> our cursory review, we see no evidence of retainage that would justify such a <br /> reduction. <br />In summary, our review indicates that a reduction of 58 acres from the total Bethel College . <br />area would be justified, reducing the SWM quarterly fee of $2,943.50. In our opinion, <br />neither the zoning/development issue nor the retained runoff issue justify any reduction in <br />the current amount being assessed Bethel College for SWM Utility fees. <br />We hope this letter adequately addresses any questions or concerns you may have regarding <br />this issue.
