CITY OF ARDEN fiLLS <br /> I MEMORANDUM <br /> I DATE: February 10, 1995 <br /> TO: Mayor and City Council <br /> I FROM: Brian Fritsinger, Community Planning coordinator@ <br /> I SUBJECT: OneComm Corp. Lease Agreement <br /> I Attached the City Council will find a revised draft lease agreement with OneComm Corp. for the <br /> placement of antennas on the Red Fox Road water tower. <br /> I Staff has worked with the City Attorney to prepare this document. This lease is similar in <br /> regards to the existing agreement with ,Cellular One but, it does have several differences. The <br /> I Council should note the following details of the agreement: <br /> .e 1. It allows for the placement of antennas on the water tower. <br /> 2. It allows for the construction of an equipment building. <br /> 3. The term of the lease is for five (5) years with four (4) additional five (5) year <br /> I options. <br /> 4. The terms are as follows: <br /> 1 st five years = $750/mo <br /> I 2nd five years = $862/mo <br /> 3rd five years = $991/mo <br /> 4th five years = $1140/mo <br /> I 5th five years = $1311/mo <br /> 5. Tenant shall provide to the City two transportable telephones. <br /> I At the last meeting, several members of the Council expressed concern about the agreements <br /> apparent lack of language protecting the City from costs to repair damages created by the tenant. <br /> I Attorney Filla and Public Works Superintendent Dan Winkel have developed some language <br /> which should adequately address this concern. This language has not been included in the lease <br /> I but should be available at the meeting. <br /> The other language which has been requested by OneComm is as follows. It would be placed in <br /> I Section 6. Attorney Filla is researching the impact of this request and is expected to have a <br /> response by meeting time. <br /> I- . <br /> I <br />
