Arden Hills, MN 55112 Rl:: : Old'Snellinq Aveuue - Ci~y Park Our File No.: 10450/950002 Brian: I I have reviewed miscellaneous documents from the City' s files . and from the County Recorder's Office in regard to the title for the small open space area south of the Kenna Addition on Old Snelling Avenue. The following is a summary of my findings and/or conclusions: .- 1. The City first acquired an interest in this property by conveyance from Ramsey County on December 18, 1978. A . Quit Claim Deed was used to convey an interest to the City, Therefore, the City only acquired whatever interest Ramsey County had to convey at the time. I presume this was a right-of-way easE!lIIElnt and not fee . title to the property. However, a more detailed review of Ramsey County records would need to be made in order to verify the status of the rights acquired by the City I in 1978. 2. On September 10, 1979, the City Council agreed to accept a conveyance of a roadway easement from Ramsey County. . This supports the position that the 1978 conveyance was for a roadway easement. In fact, the 1978 conveyance was not recorded until July 9, 1980. The City Council went on to indicate that its intent was to record the easement . and then proceed to vacate it and, in tlUs manner, free up title for Siems Brothers, Inc, This indicates to me that Siems Brothers was the underlying fee owner of the - property. 3.
