All that part of Government Lot 1 and the Northeast ~ of . the Northwest ~ of Section 34, Township 30, Range 23 which lies Northeasterly of a line beginning at a point on the North line of said Section 34, distant 968.0 feet I East of the Northwest corner thereof; then run Southeasterly at an angle of 70 degrees 29 minutes 00 seconds with said North Section line for a distance of 600 feet and there terminating; and which lies I Northwesterly of the following described line: Commencing at the Northeast corner of said Northeast ~ of the Northwest ~, thence West along a North line of said I Northeast ~ of the Northwest ~ a distance of 1062.03 feet to the point of beginning of the line to be described, thence deflecting to the left 54 degrees 19.5 seconds to the point of intersection with the first above-described I line and there terminating (herein "Lindy Park"). The title to Kenna Park was examined by means of an Abstract I of Title consisting of entries 1 through 145 last certified on the 3rd day of March, 1995, at 8:00 o'clock a.m. by the Old Republic National Title Insurance Company. Assuming said Abstract of Title .. and the conditions thereof to be true, correct, and complete, I am of the opinion that on said last mentioned date, fee title to Kenna Park was in the name of John J. Kenna, Jr., subject to the following limitations: . 1- The entire area of Kenna Park is subject to a roadway easement in favor of the City of Arden Hills (see . Abstract Entry Nos. 136 and 138). 2. Al though this information does not appear on the Abstract of Title, when the City of Arden Hills approved the plat . of Kenna Addition, the fee owner utilized the area of Kenna Park to satisfy the City's park dedication l- requirement. Therefore, the area of Kenna Park has also I been dedicated for park purposes even though this entry does not appear of record or as part of the plat of Kenna Addition. I The title to Lindy Park was examined by means of an Abstract of Title consisting of entries 1-142 last certified on the 3rd day of March, 1995, at 8:00 o'cLOCK a.m. by the Old Republic National . Title Insurance Company. Assuming said Abstract of Title and the conditions thereof to be true, correct, and complete, I am of the opinion that the fee title to Lindy Park on said last mentioned . date was in the name of John J.
