I
I &RD~~ HII"l-S CITY COUNqL - APRIL 24,) 994 ,
I- ~
Mr. Fritsinger indicated the Council should note Section 3.0(A) of the Development Agreement.
I Previously the consultant planner recommended approval of this proposal subject to a joint PUD
application on the overall site by CSM, Control Data and Dynamark. Further negotiations between
representatives of these firms and the City Attorney have resulted in language which does not require
I a joint application.
Mr. Fritsinger indicated additional information is also found in the AprilS, 1995 Planning
I Commission Meeting Minutes.
Councilrnember Keirn inquired if the road accessing the property will be a private road. Mr.
I Fritsinger indicated this would be correct.
Councilmernber Keirn asked if the City would be creating a land locked parcel. Mr. Fritsinger
I indicated this would not be the case, there is still access to Lexington A venue and access easements
will also be created.
I ,
Mayor Probst asked if there will still be an easement for access to Cummings Park. Mr. Fritsinger
stated yes, there would still be an easement.
Ie MOTION: Malone moved and Aplikowski seconded a motion to approve Planning Case #95-11,
Control Data - Minor Subdivision with the stated conditions. CSM - Site Plan Review
I Mr. Fritsingerreferred to the Planning Commission meeting minutes of AprilS, 1995, and indicated
the concern regarding the NURP Pond. Mr. Fritsinger said it was his understanding that after a
I meeting with Rice Creek Watershed District and CSM, Mr. Bergly, the Planning Consultant stated
there is no requirement for a holding pond. Mr. Fritsinger indicated the applicant is still planning
on installing a fence.
I Councilmernber Hicks asked what the elevation of the pond would be. Mr. Fritsinger indicated the
I pond will hold only minimal water, unlike a sediment or holding pond.
Ms. Lori Johnson, civil engineer for the project, indicated the volume of the pond would be for two
I to two and one-half inches of rainfall. She indicated this amount could fluctuate with the weather.
Councilmember Aplikowski inquired as to where the fencing would be. Mr. Fritsinger pointed out
~ the fencing would surround the pond area.
Mayor Probst asked if the future building would have docking areas for trucks.
