Public Hearinl! - 1995 Street Maintenance Improvement Proiect Assessments I The Council is asked to adopt Resolutions 95-50 and 95-51 which adopt the fmal assessment roll for the project. The residents of the Hunters Park Homeowners .- Association were each notified of the Hearing and included on the final assessment roiL The Council will recall that only the residents abutting Benton Way were initially included in the Public Hearing. I At that meeting the Council asked Staff, based on comments from a member of the Homeowners Association, to investigate how similar associations had been assessed in the past. Previously, the City had assessed the Arden Hills Townhome . Association with a similar approach. Hunters Park residents have now met with staff and expressed their displeasure about not being notified of the project prior to . the Notification of being assessed. The Council will find a copy of correspondence from Attorney Filla indicating this . Notification is legal under Statute and City policy, The Council may wish to consider the assessment of this matter in more depth. . In addition, over the past week, Staff has determined that of the approximate 200 Hearing Notices provided by the engineer, thirty (30) notices may have been sent to residents no longer living in Arden Hills., Staff has followed up with a copy of the . Notice and courtesy letter informing the current residents of the Hearing. The Council should also consider the Petition from the residents of Lametti Circle I to be removed from this Project. This Petition was included in a previous Council packet. The residents support the Project but wish to have the street repaired at a .- future date along with Lametti Lane. I
