Extra Work <br /> I If requested and authorized in writing by the CITY and approved by CONSULTANT as <br /> set forth in Paragraph B above, CONSULTANT will be available to furnish, or obtain <br /> I from others EXTRA WORK and be compensated for said work beyond the total lump <br /> sum amount of$120,OOO fixed in Paragraph F above. EXTRA WORK can be work of the <br /> following type: <br /> I 1. EXTRA WORK due to changes in the general scope of the study including, but <br /> not limited to, changes in size, complexity, or character of the work items. <br /> I 2. Additional or extended services including study administration due to: a) the <br /> . prolongation of the Agreement time through no fault of CONSULTANT, b) the <br /> acceleration ofthe work schedule involving services beyond normal working <br /> hours, c) additional copies of reports, d) non-performance of the CITY Services <br /> I (Attachment 2) or e) non-delivery of any materials, data or other information to be <br /> furnished by the CITY and others not within the control of CONSULTANT. <br /> I 3. The Scope of Services is expanded to include the Master Reuse Plan, Detailed <br /> Area Plan, Financial Plans, Business Development Strategy and marketing <br /> .- strategy as specified in Phases 3 and 4 in the detailed work plan attached to the <br /> contract. <br /> 4. Additional meetings ~ CITY, general public, or City Council beyond those <br /> I specified in Compone t A- above. <br /> 5. Other additional services requested and authorized by written WORK ORDER by <br /> . the CITY which are not otherwise provided for under this Agreement. <br /> I. Nondiscrimination and Affirmative Action <br /> I <br /> CONSULTANT agrees not to discriminate by reason of age, race, religion, color, sex, <br /> I national origin, familial status or handicap unrelated to the duties of a position of <br /> applicants for employment or employees as to terms of employment, promotion, <br /> demotion or transfer, recruitment, layoff and termination, compensation, selection for <br /> I training, or participation in recreation and educational activities. The CONSULTANT <br /> actively seeks qualified minorities when filling professional, technical and clerical <br /> positions. <br /> I J. Hold Harmless <br /> I The CONSULTANT shall and hereby agrees to hold and save the CITY harmless for any <br /> and all claims arising out of the negligent acts of CONSULTANT or any of <br /> .- CONSULTANT'S employees in the performance of this agreement. <br /> . <br />
