The rules and regulations which apply to this development are based on well established <br /> practices by the reviewing agencies to prevent and mitigate the anticipated effects of the <br /> development activity. Specifically, this development proposal will be required to meet: <br /> . the standards found within the Shoreland Management and Floodplain regulations; <br /> provide wetland buffers, as requested by the DNR; provide tree preservation measures; <br /> comply with the Best Management Practices for erosion and sediment control, as required <br /> . by the MPCA; and comply with the rules and regulations of the Rice Creek Watershed <br /> District. <br /> . The EA W, public comments on the EA W, and responses to those public comments have <br /> adequately identified the environmental effects which may be reasonably expected to <br /> occur from this 16 unit residential project. The identification of and mitigation <br /> . procedures for these environmental effects will provide the City Council sufficient <br /> information to make an informed decision on this development proposal. <br /> .- Recommendation <br /> The Staff recommends in the Environmental Assessment Worksheet for the T ownhomes of Lake <br /> . Valentine that: <br /> 1. The City Council adopt the responses to the public comments; <br /> . 2. The City Council adopt the findings of Fact; <br /> " The City Council adopt a negative declaration on the need for an EIS; <br /> ~. <br /> 4. The City Council authorize Staff to distribute the responses to the public comments; and <br /> . 5.
