MEMORANDUM <br /> DATE: October 10, 1995 <br /> TO: Mayor and City Council <br /> FROM: Kevin Ringwald, Community Development Director ~ <br /> SUBJECT: Easement Vacation-Sanitary Sewer (Case #95-05) <br /> - <br /> Reouest <br /> The applicant (Dan Ogren) is requesting that the City vacate a 20 foot wide sanitary sewer <br /> easement on the property located at the Northwest comer of Old Highway 10 and County Road <br /> - E2. The vacation request was made in conjunction with the applicants development proposal, the <br /> Townhomes of Lake Valentine (Case #95-05). <br /> - <br /> I Discussion <br /> The property located at the Northwest comer of Old Highway 10 and County Road E2 contains a <br /> two (2) sanitary sewer easements, one in the Southwest comer of the site and the second across <br /> Ie the Northerly portion of the site. The sanitary sewer easement in the Southwest comer of the site <br /> contains the sewer line which serves the Chatham neighborhood. The sanitary sewer easement in <br /> the Northerly portion of the site contains a main line sewer which serves most of the residential <br /> I unit in the area. <br /> The sanitary sewer line in the Northerly portion of the site is not entirely contained within the <br /> I sanitary sewer easement which was provided for that sewer line. The applicant is requesting that <br /> the City vacate the entire 20 foot wide sanitary sewer easement, and the applicant will provide a <br /> new 20 foot wide sanitary sewer easement centered on the existing sanitary sewer line with the <br /> I platting of the Townhomes of Lake Valentine (Exhibit A). The Planning Commission at their <br /> September 6, 1995 regular meeting recommended approval of the vacation of the 20 foot wide <br /> I sanitary sewer easement, subject to it being replaced by a 20 foot wide sanitary sewer easement <br /> centered over the existing sanitary sewer line. <br /> I If the City were to vacate the sanitary sewer easement and then the plat was not filed with <br /> Ramsey County, then the City would have no rights to maintain the presence of the sewer line on <br /> the subject property. Therefore, it would be appropriate to condition the vacation of the sanitary <br /> I sewer easement on the filing of the plat of the Townhomes of Lake Valentine. <br /> I <br /> .. <br /> I <br /> -- <br />
