FROM: Kevin Ringwald, Community Development Director ~ <br /> SUBJECT: Case #95-1, Site Plan extension <br />. One Comm, 1230 Red Fox Road <br /> Plannin1! Case 95-1 <br />. A. Request. <br /> The applicant is requesting an extension of their site plan approval to June 30, 1996 so as <br />. to accommodate their anticipated construction of transmission towers at the Red Fox <br /> Road water tower (Exhibit A). <br />. B. Discussion. <br /> Tbe applicant received special use permit and site plan approval from the City Council at <br />.- its regular meeting of January 30, 1995 in Planning Case 95-01. The approval allowed <br /> for the construction of transmission towers on the Red Fox Road water tower (Exhibit B). <br />. The Zoning Ordinance in Section VII!, F, 2, states in relevant part, "Approval shall <br /> automatically expire and become void one (1) year from and after the date on which the <br /> council granted such approval if the building permit or other approved improvements <br />I have not been issued a permit by the building inspector. The council may extend the <br /> expiration date of such approval upon written application by the person to whom the <br /> approval was granted". Therefore, the City Council approval of Planning Case 95-01 <br />. expires on January 30, 1996. <br /> C. Recommendation <br />. The Staff recommends that the approval of Planning Case 95-01 be extended until June <br /> 30,1996, subject to the original conditions of approval. <br />. <br />. <br />. <br />.. <br />I <br />
