C. 20515-2304 <br /> Dear Mr. Vento: <br />I Thank you for your letter dated October 16, 1995, regarding your concerns for the <br />I future uses of the Twin Cities Army Ammunition Plant (TCAAP) and your support of <br /> the Reutilization Committee's resolution. <br />I The Bureau of Indian Affairs (BIA) will not support a request from a federally <br /> recognized Indian tribe for acquiring Federal "excess" real properties for Indian gaming <br /> purposes. The BIA does not have the authority to acquire "excess" real properties for <br />I- use by an Indian tribe pursuant to the Indian Gaming Regulatory Act. The BIA would <br /> consider a request from the Prairie Island Community Council (Tribe) if the property <br /> will be used in the performance of Tribe's contract and/or grants awarded pursuant <br />I Public Law 93-638, the Indian Self-Determination and Education Assistance Act. The <br /> Prairie Island Community Council (Tribe) may purchase property at the TCAAP <br /> through a "negotiated sale" at the "surplus' level pursuant to the Federal Property and <br />I Administrative Services Act of 1949. <br /> My staff also met with the Tribe and informed them of the Federal "excess" and <br />I "surplus" processes.
