<br />I <br />'. 211 reasonable suspicion test, or a follow-up alcohol test mandated by this policy and <br /> federal law. <br />I - <br /> (k) The City shall not permit a driver who refuses to submit to the mandated alcohol <br />I tests under this policy and federal law to perform or continue to perform safety <br /> sensitive functions. <br />. Conduct Related to Controlled Substances <br /> 382. (a) No driver shall report for duty or remain on duty requiring the performance of <br /> 213 safety sensitive functions when the driver uses any controlled substance, except <br />. when the use is pursuant to the instructions of a physician who has advised the <br /> driver that the substance does not adversely affect the driver's ability to safely <br /> operate a commercial motor vehicle. <br />. 382. (b) The City, having actual knowledge that a driver has used a controlled <br /> 213(b) substance, shall not permit the driver to perform or continue to perform a safety <br />. function unless use is permitted pursuant to the written instruction of a physician. <br /> 382. (c) A driver shall inform the driver's supervisor of any therapeutic drug use. <br />. 213(c) <br />.. 382. (d) No driver shall report for duty, remain on duty, or perform a safety sensitive <br /> 215 function, if the driver tests positive for controlled substances. <br />. 382. (e) The City, having actual knowledge that a driver has tested positive for controlled <br /> 215 substances, shall not permit the driver to perform or continue to perform safety <br /> sensitive functions. <br />. <br /> 382. (f) No driver shall refuse to submit to a post-accident controlled substance test, a <br />I 211 random controlled substance test, a reasonable suspicion controlled substance test <br /> mandated by this policy and federal law. <br /> - <br />. 382. (g) The City shall not permit a driver who refuses to submit to the mandated <br /> 211 controlled substance tests to perform or continue to perform safety sensitive <br /> functions. <br />. 5. TYPES OF TESTS REQUIRED <br />. Pre-employment Testing <br /> 382.3011 <br /> 382.413 Prior to the first time a driver performs safety sensitive fuoctions for the City, the <br />. driver shall undergo testing controlled substances.
